Petr Svab at the Epoch Times highlights why the Government’s case against President Trump will be a difficult one: The federal government has relied on charging Trump with violations of the Espionage act, although the holding of Presidential Records is governed by the Presidential Record Act, which is not a criminal statute.

Additionally, as President, Trump had universal authority to declassify records.

“Even if President declassifies his presidential records and takes them when he leaves office, he can still get charged under Espionage Act. … Promise that theory won’t fly with Supreme Court.”
